Penalty for Hit-and-Run Accidents in the Netherlands

The short answer

Leaving the scene of an accident is punishable under Article 7 of the Road Traffic Act. You risk up to 3 months in prison or a fine of up to €4,350. In accidents with injuries, the penalties can be much harsher. You can also lose your driver's license. Stopping and leaving your information is always the best choice.

What does the law say?

Dutch law is very clear about hit-and-run. Article 7 of the Road Traffic Act obliges you to stop after any accident, even with only material damage. You must reveal your identity and provide assistance if necessary. Not stopping is considered a criminal offense, not a violation.

What should you watch out for?

Note that even minor collisions count as accidents where you must stop and contact the owner. If you return later, this can still be considered hit-and-run. The police can use witnesses and CCTV footage to prove that you left the scene.

Imagine you hit another car while parking and think 'it's not that bad, no one saw it.' You drive off, but a resident has filmed everything and noted your license plate. A week later, the police are at your door. Now you're not only prosecuted for hit-and-run, but you also have to pay the damages. If you had left a note, it would have only been about the damage.

What can you do?

If you have already left the scene, report to the police as soon as possible. Honesty can lead to a reduced sentence.
